Librarian's guide to Artificial Intelligence

Artificial Intelligence in Electronic Resources License Agreements

There are mentions of the use of artificial intelligence tools in the terms of use of some of the most recent license agreements of databases subscribed by the library. It is very likely that this will continue as agreements are renewed.

From the point of view of publishers, it is particularly important that the resources they publish are not used for training of AI and that the organization providing the AI tool cannot use or share the material uploaded to the tool. So far, there are mentions of the use of AI tools in Elsevier's ScienceDirect Freedom and Springer Nature's Springer Compact agreements.

Examples of agreement texts:

and

  • Clause: Except as expressly stated in this Agreement or otherwise permitted in writing by Elsevier, the Institution and its Authorized Users may not use the Subscribed Products in combination with an artificial intelligence tool (including to train an algorithm, test, process, analyse, generate output and/or develop any form of artificial intelligence tool) except where such artificial intelligence tool is used locally in a self-hosted environment or hosted environment solely for use by such Institution or Authorized user, is not trained using the Subscribed Products or any part thereof for the benefit of a third party and does not share the Subscribed Product or any part thereof with a third party except for use by such Institution or Authorized user as set out in this Agreement.

Further, neither Licensee nor Authorized Users may use any part of the Content to train, directly or indirectly, any AI tool or system.

Wiley agreement 2023-2024

  • There is no clause on AI in the agreement but Wiley's policy on using AI can be found on publisher's web pages.

Agreements with publishers have been made by the FinELib office of the National Library of Finland, which negotiates e-resources subscriptions and promotes availability of e-resources and open publishing, on behalf of the Finnish libraries belonging to the FinELib consortium. The full texts of the agreements can be found on FinELib's website.
